A terrible decision by the court – Agbodza on order to OSP to return Dapaah’s seized property

The Office of the Special Prosecutor (OSP) was ordered by the court to give the former Minister of Sanitation and Water Resources Cecilia Abena Dapaah’s confiscated property back. According to the Minority Chief Whip, Kwame Agbodza, this was a poor judgment.

“A very terrible decision by the Court. What is the rationale for this?” He tweeted.

The OSP has been given seven days to restore Cecilia Abena Dapaah’s confiscated property, according to an order from the Financial Division of the Accra High Court.

The OSP entered the act incorrectly, according to the court, hence there was no legitimate ground for the seizure of the property.

The Court further determined that the OSP lacked justification to freeze the former Bantama Member of Parliament’s (MP) bank accounts.

It claimed that the OSP’s response was based on rumors and an emotional response from the public, leading to shoddy investigations afterward.

On August 31st, the decision was made.

In compliance with section 38(1) of Act 959 and regulation 19(1) of LI2374, the OSP had requested permission from the High Court to impose a temporary account freeze on Madam Abena Dapaah’s accounts at Prudential Bank and Societe Generale Ghana.

The OSP stated that the confirmation was necessary in order to speed up investigations.

A search of the former sanitation minister’s Abelemkpe home turned up $590,000 and GH2.73 million, as it was stated in the motion.

It then placed her under house arrest after determining that there were solid reasons to believe she was involved in corrupt practices.

However, the court has denied the entire application.
